Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by Destesi ("Destesi", "we", "us", or "our"), including the Destesi product suite and the Destesi Connect integration platform (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Eligibility & accounts

You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. The Services

Destesi provides AI-native tools for developers and teams, including database branching, preview environments, content generation, and third-party application connectivity through Destesi Connect. We may add, modify, or discontinue features at any time. We will make reasonable efforts to notify you of material changes that adversely affect your use of the Services.

3. Third-party services & connections

The Services let you connect third-party applications and accounts (for example, Slack, GitHub, HubSpot, Intercom, Zoom, and others) through OAuth or API credentials that you authorize. When you connect a third-party account, you authorize Destesi to access, store, and process data from that account solely to provide the Services you have requested.

Your use of any third-party service is governed by that third party's own terms and privacy policies. Destesi is not responsible for the practices, availability, or content of third-party services. You may revoke any connection at any time, after which we will stop accessing the corresponding third-party account.

4. Acceptable use

You agree not to:

• Use the Services to violate any law or the rights of others;
• Attempt to gain unauthorized access to the Services or related systems;
• Interfere with or disrupt the integrity or performance of the Services;
• Reverse engineer or misuse credentials, tokens, or access granted to you;
• Use the Services to transmit malware or to send unsolicited communications.

5. Your content & data

You retain all rights to the data and content you submit to or connect through the Services ("Your Content"). You grant Destesi a limited license to host, process, and transmit Your Content as necessary to operate and provide the Services. Our handling of personal data is described in our Privacy Policy.

6. Fees

Some Services are offered under free and paid plans. Where fees apply, they will be presented to you before you incur them. Unless otherwise stated, fees are non-refundable except as required by law.

7. Intellectual property

The Services, including all software, design, and content provided by Destesi, are owned by Destesi and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding without our prior written consent.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Destesi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Services. Our total liability for any claim arising out of these Terms will not exceed the amounts you paid us for the Services in the twelve months preceding the claim.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Services ceases, and we may delete Your Content in accordance with our retention practices.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
